ELECTRICITY REGULATORY COMMISSION
INTRODUCTION
The proviso to Section 16 of
the Electricity Act 2003 stipulates that the appropriate Commission shall,
within one year from the appointed date, specify any general or specific
conditions of Licence applicable to the licensees
referred to in the first, second, third, fourth and fifth provisos to section
14 after the expiry of one year from the commencement of the Act. The Licences granted to the Transmission Corporation of A.P.
Ltd., (APTRANSCO) and four Distribution Companies namely, Central Power
Distribution Company of A.P. Ltd., (APCPDCL), Southern Power Distribution
Company of A.P. Ltd., (APSPDCL) Eastern Power Distribution Company of A.P.
Ltd., (APEPDCL), Northern Power Distribution Company Ltd., (APNPDCL) falling
under the first proviso contained General Conditions of Licence
as well as certain specific conditions as mentioned in the individual Licences granted to the respective Licensees. The
Commission is in the process of finalising the
Regulation for General Conditions of Licence u/s 16
of the Electricity Act, 2003, and the same will take some time for the
notification. The Commission therefore decided to make a transitory Regulation
to be in force till the new Regulation is framed and accordingly published a
draft Regulation in the A.P. Gazette on

conferred u/s 181 read with Section 16 of the Electricity Act, 2003 (Act 36 of
2003) and other powers enabling the Commission in that behalf, the Commission
hereby makes the following Regulation, namely:
(i) This Regulation
may be called the A.P. Electricity Regulatory Commission (Deemed Licence Conditions) Regulation, 2004.
(ii) This Regulation
shall be deemed to have come into force on

contained in the respective Licences issued to the
Transmission Corporation of A.P. Ltd., (APTRANSCO) and the four Distribution
Companies namely, Central Power Distribution Company of A.P. Ltd., (APCPDCL),
Southern Power Distribution Company of A.P. Ltd., (APSPDCL), Eastern Power
Distribution Company of A.P. Ltd., (APEPDCL), Northern Power Distribution
Company Ltd., (APNPDCL) under the A.P. Electricity Reform Act, 1998 shall be
deemed to have been specified u/s 16 of the Electricity Act, 2003 till the notification
of an appropriate Regulation as mentioned in the Introduction above.
