1. Sections 39 (2)(d)(ii)
and 40(c) of Electricity Act, 2003 (hereinafter referred to as ‘the Act’)
provide for payment of a surcharge (hereinafter also referred to as ‘the
cross-subsidy surcharge’) when a transmission system is used for open access
for supply of electricity to a consumer and Section 42(2) of the Act provides
for payment of the surcharge in addition to the wheeling charges as determined
by the State Commission.
2. As per the aforementioned
provisions, the surcharge has to be utilized to meet the requirements of
current level of cross-subsidy.
3. Pursuant to the above
provisions, the Commission laid down the methodology for computation of the
surcharge and additional surcharge in its order dated 29-08-2006 in O.P.
(Suo-moto) No. 13 of 2006. This order
is posted on website of the Commission.
4. The Commission intends to
determine surcharge and additional surcharge payable for 2007-08 for Open
Access consumers of different categories under the aforementioned provisions of
the Act in terms of the methodology adopted in the earlier order. The said charges so determined will be
co-terminus with the relevant tariff fixed by the Commission for such period.
5. The
details of the surcharge arrived at in terms of the said methodology
considering the relevant parameters as per the Retail Supply tariff fixed by
the Commission for different categories of consumers for 2007-08, in respect of
the four DISCOMs namely CPDCL, EPDCL, NPDCL and SPDCL are given in the document
“cross subsidy surcharge calculation for 2007-08”. The same will be made available to interested persons on written
request addressed to the Secretary, APERC at the above address. The said document is also posted on the
website of the Commission – www.ercap.org.
6. The Commission invites
suggestions / objections, if any, from the public / interested persons,
stakeholders and persons likely to be affected, by 5:00 p.m. on 23-04-2007 on
the above proposal. Those who want to
be heard in person may indicate so in their written objections. The Commission will hear such persons and
consider their views, along with the written objections / suggestions received
in this regard before fixing the cross-subsidy surcharge for 2007-08. The date and venue of hearing will be
communicated to the persons who seek hearing in person.
