AMENDMENT TO ORDER O.P.No.19/2006 dated 30-12-2006

 

           Consequent to grant of consent by the Commission on 30-12-2006 in O.P.No.19 of 2006 to the amendments to the Power Purchase Agreement (PPA) dated 31-03-1997 and amendment agreement dated 18-06-2003 entered into between APDISCOMs and M/s. Vemagiri Power Generation Limited, the above mentioned parties filed separate affidavits dated 28-03-2007 and 29-03-2007 respectively, requesting the Commission to modify Article 2.1 of the PPA with regard to “Sale and Purchase of Capacity”.

 

           The Commission after careful consideration agrees to modify Para 1 of Article 2.1 and in pursuance thereof, the following amendment to the Order dated 30-12-2006 in O.P.No. 19 of 2006, is issued

 

FOR

 

 

“Sale and Purchase of Capacity:

From and after the Commercial Operation Date of the first Generating Unit, subject to the provisions of this Agreement, the Company shall sell, and the APDISCOMs shall purchase, for the consideration of the Capacity Charge, all the available capacity of the Project limited to 370 MW”.

From and after the Commercial Operation Date of the first Generating Unit, subject to the provisions of this Agreement, the Company shall sell, and the APDISCOMs shall purchase, for the consideration of the Capacity Charge, all the available capacity of the Project limited to Installed Capacity of 370 MW.”

 

           Except the said amendment, the Order dated 30-12-2006 will continue to be in operation.
