ORDER

 

WHEREAS the Commission’s Renewable Power Purchase Obligation (RPPO) Order dated 27-09-2005 in O.P.No. 9 of 2005 in the matter of specifying for purchase of electricity from renewable sources of energy including co-generation a percentage of the total consumption of electricity in the area of a distribution licensee (hereinafter referred to as the ‘RPPO Order’), as required in section 86 (1) (e) of Electricity Act 2003, is valid for a control period of 3 years, from 2005-06 to 2007-08 and is coming to an end by 31st March 2008 and a new order has to be issued by the Commission applicable from 1st April 2008.

 

AND WHEREAS in order to enable the Commission to issue a fresh RPPO Order applicable with effect from 1stApril 2008, considers it desirable as a first step the preparation of a consultative paper on which the objections/ suggestions   of the general public and other stakeholders can be sought. 

 

AND WHEREAS to facilitate preparation of such a consultative paper certain information /reports/ proposals have been requested from the DISCOMs (the distribution licensees viz: APSPDCL, APCPDCL, APEPDCL and APNPDCL) and NEDCAP vide letters dated 05-02-08 and while the NEDCAP has furnished the information /proposals vide their letter dated     15-02-08, the same is yet to be received from the DISCOMs.

 

AND WHEREAS in view of the above situation, as the consultative process in respect of issuance of the RPPO Order applicable from 1st April 2008 is likely to take some more time and could not be completed before 31st March 2008, it is expedient that the present RPPO Order dated 27-09-2005 in O.P.No.9 of 2005 is extended for some more time, beyond 31st March 2008.

 

 

NOW THEREFORE the Commission having considered the matter extends the validity of the RPPO Order dated 27-09-2005 in O.P.No.9 of 2005 till 31st July 2008, to the extent the Order has not been set aside by the Appellate Tribunal for Electricity (ATE) in its orders dated 02.03.2006 in Appeal Nos. 173, 174, 178, 182, 183, 184 of 2005.
