After careful consideration of the matter, it is clear that in the cause title, the name of the petitioner is alone shown. Relief is also claimed on behalf of the petitioner shown in the cause title. On behalf of the petitioner, its Chairman & Managing Director signed in the accompanying verified affidavit on behalf of the petitioner alone. However, in the petition as well as in the accompanying affidavit, above the cause title, it is mentioned that the review petition is being filed on behalf of the petitioner as well as on behalf of other 3 distribution licensees in the State.

Thus strictly speaking granting permission to amend the review petition by way of deleting the name of other DISCOMs in the cause title of the review petition as well as in the affidavit will not arise on the face of it.

In these circumstances, the Commission is of the opinion that interest of justice would be met if the petitioner is permitted to withdraw the review petition by filing a memo and thereafter, resubmit suitable petition afresh, along with application for condonation of delay. For the said reason, it is not necessary to pass any order on the amendment application/petition.

Two weeks time from the date of receipt of this order is granted to APCPDCL to file a review petition afresh, if so desired, on the subject matter.

Ordered accordingly.
