All the five applicants have filed a combined petition requesting the Commission to permit them to file additional filings in respect of proposed tariff and ARR and grant them reasonable time for filing the same.

The Commission on consideration passed the following common:

ORDER

1)     All the five petitioners have submitted their filing of ARRs and Tariff for FY 2005-06 on 30.11.2004 as contemplated under Section 61 of the Electricity Act read with Section 26 of A.P. Electricity Reform Act, and published the same in daily newspapers.  Consequent on the publication, several persons, associations, organizations, and political parties have filed their comments.  The said comments were all forwarded to the petitioners for their replies/comments.  Meanwhile, the Commission has also announced dates of public hearing in the process for finalisation of Tariff Order for FY 2005-06.

2) While so, the petitioners filed this petition stating that Government of Andhra Pradesh (GoAP) has announced a policy on power supply to agricultural consumers in modification of its earlier policy of free supply of power to agricultural consumers on 25.01.2005.

3)  The petitioners stated that they had made their estimations of ARRs and filed their filings on 30.11.2004 based on the Government policy then in force and now that the Government has modified its policy and intended to collect certain specified charges from some categories of agricultural consumers instead of allowing them free supply of power.  The petitioners stated that it necessitates re-estimation of their ARRs and change in tariff structure for agricultural consumers and they have also to file additional/ addendum filings in respect of tariff and ARRs filed earlier on 30.11.2004.

4)  The petitioners have also stated that in view of the changed policy of GoAP announced on 25.01.2005, it is necessary for them to re-estimate their revenue as some categories of agricultural consumers would now be required to be charged at different rates.  Therefore, they prayed for time to revise their filings in respect of tariff and ARRs for FY 2005-06.

5)   On consideration, the Commission accepts the necessity of re-estimation of ARRs by the petitioners in view of the changed policy of Govt stated by the petitioners. The Commission also agrees that the petitioners need to be  given some time for making their re-estimations and for  filings of their additional filings in respect to  tariff and ARRs.

6)   Taking into account, the mandated obligation on the part of the Commission to issue the Tariff Order for FY 2005-06 to be effective from 1st April 2005, the Commission grants time of ten days to the petitioners for submitting their revised filings.

 

The order is corrected and signed this day the 28th January, 2005.
