Whereas a
conciliation meeting was held in the office of the Ombudsman, Hyderabad between
the parties herein, on 09-03-2007, pursuant to the notice issued on 20-02-2007,
and
2. Whereas,
considering the circumstances of this case as ascertained during the said
meeting, the Ombudsman is of the view that a reasonable settlement is feasible,
and
3. Accordingly
in terms of clause 11 of the Regulation No. 1 of 2004 of the Hon’ble APERC, the
Ombudsman makes a recommendation (proposal) for settlement by mutual agreement
between the parties as indicated in the Annexure of these proceedings.
4. The
parties herein are requested to confirm their acceptance or otherwise for the
proposed settlement within 15 days of receipt of these proceedings.

Recommendation of Ombudsman in terms of
clause 11 of Regulation No. 1 of 2004 of Hon’ble APERC pursuant to the
conciliation meeting held on 09-03-2007

1. The bills in respect of Agricultural
service Nos. 9,10,27 and 68 of Abdulanagaram shall be raised for the year
2005-06, and 2006-07 on the basis of equivalent flat rate on HP basis, as per
relevant Tariff Order of the Commission.
2. The bills already issued shall be
withdrawn.
3. From April 2007 onwards, the bills may
be raised on the basis of metered tariff as per the Tariff Order to be issued
by the Hon’ble Commission for 2007-08.
4. The appellant shall be at liberty to
make representations to the appropriate authority for cancellation of SC No. 27
and the concerned authorities shall take appropriate action in accordance with
law on receipt of such representation.
