Whereas Sri B.Subramanyam, a senior citizen, filed a complaint before the Forum for redressal of grievances of consumers (herein after called the Forum or CGRF) CPDCL, Hyderabad regarding change of name of consumer of S.C.No.1701-00 00471 from Smt.G.Vasantha to Sri.B.Subrahmanyam in the receipts issued by e-seva for payments, and
Whereas the learned Forum in its order dated 29-08-2006 in CG No. 13/2006-RR/N-Circle disposed off the complaint with an observation that the respondent is liable to pay compensation in terms of Regulation No.7 of 2004 for the delay in effecting the change of name in the receipts from October 2005, and
Whereas the appellant filed this appeal dated 26-09-2006 staking his claim for Rs. 1000 towards costs incurred in correspondence with respondents and Rs 2000 towards physical and mental agony for not changing the consumer’s name in the receipts issued by e-seva center and,
Whereas no settlement was reported nor counter/rejoinder filed by the parties herein, who also did not attend for hearing scheduled on 27-11-2006 pursuant to notice issued on 29-09-2006, and
Whereas the Regulation No. 1 of 2004 of Hon’ble APERC does not delegate any power either to the Forum or the Ombudsman to grant any compensation as such for deficiency in service of the Distribution Licensee, while such compensation is governed by the provisions in the Regulation No.7 of 2004.
Now therefore the Ombudsman hereby directs the respondent to pay compensation to the appellant interms of Regulation No.7 of 2004.
The appeal is disposed off accordingly with the above direction.
